1. Acceptance of these Terms
These Terms of Service ("Terms") are an agreement between you and Capsule, operated under the Made on Capsule brand ("Capsule," "we," "us," or "our"). They apply when you access or use the Capsule iOS app, madeoncapsule.com, and related services.
By creating an account, signing in, uploading content, sending messages, joining a capsule, or otherwise using Capsule, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Capsule.
2. Eligibility
You must be at least 13 years old to use Capsule. If local law requires a higher minimum age, you must meet that age or have appropriate parent or guardian consent.
You may not use Capsule if you are legally barred from using the service, if we previously suspended or terminated your account for serious violations, or if your use would violate applicable law.
3. Accounts and security
You are responsible for the information you provide, the activity that happens under your account, and keeping your sign-in credentials secure. Do not share your password, authentication codes, or access tokens with anyone.
You agree to provide accurate account information and keep it reasonably up to date. We may refuse, reclaim, or change usernames that are misleading, infringe rights, impersonate someone, or create safety risks.

4. Your content and capsules
You keep ownership
You keep ownership of photos, videos, text, captions, messages, comments, stickers, profile information, and other content you create or upload to Capsule ("User Content").
Permission to operate Capsule
You grant Capsule a worldwide, non-exclusive, royalty-free license to host, store, upload, download, process, transcode, display, reproduce, distribute, and otherwise use your User Content only as needed to provide, secure, improve, and support Capsule. This includes showing your content to the people allowed by your capsule settings, rendering edited media, generating thumbnails or previews, delivering messages, and operating backups or moderation systems.
Your responsibility
You are responsible for your User Content. You represent that you have the rights needed to upload it, share it, and grant the license above. Do not upload content that violates someone else's privacy, publicity, copyright, trademark, or other rights.
Capsule visibility
Capsule includes private, clique, solo, public, hidden, and other sharing controls. We design these controls to respect your choices, but you should only share sensitive content with people you trust. Other users may save, record, screenshot, describe, or further share content in ways Capsule cannot fully prevent.
5. Rules for using Capsule
You agree not to misuse Capsule or help anyone else misuse it. Prohibited activity includes:
- Harassment, threats, bullying, stalking, or targeted abuse.
- Sexual exploitation, child sexual abuse material, or content involving minors in a sexualized context.
- Impersonation, deceptive identity use, scams, phishing, or fraud.
- Uploading or sharing content that violates another person's rights or privacy.
- Hate speech, credible threats of violence, or encouragement of self-harm or harm to others.
- Spam, mass unsolicited messaging, scraping, credential harvesting, or automated abuse.
- Trying to bypass privacy settings, blocks, access controls, rate limits, security protections, or technical restrictions.
- Reverse engineering, interfering with, overloading, or disrupting Capsule or its servers except where law clearly permits otherwise.
- Using Capsule for illegal activity or to distribute malware, harmful code, or unauthorized surveillance.
We may remove content, limit distribution, disable features, suspend accounts, terminate accounts, or report activity to appropriate authorities when we believe these rules, these Terms, or the law may have been violated.
6. Privacy
Our Privacy Policy explains what information we collect, how we use it, how it may be shared, and the choices you have. Please read it carefully.
7. App stores and third-party services
Capsule may be downloaded through the Apple App Store and may use third-party services such as Apple, Google, Cloudinary, Firebase, hosting providers, notification services, analytics, diagnostics, and support tools. Your use of those services may also be governed by their own terms and privacy policies.
If you download Capsule from Apple's App Store, Apple is not responsible for providing maintenance or support for Capsule except where required by applicable law. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the iOS app and may enforce those terms against you.
If paid features, subscriptions, or in-app purchases are offered, purchase and refund handling may be managed by the app store provider according to that provider's rules, unless we clearly state otherwise.
8. Service availability and changes
Capsule is provided as an evolving service. We may add, change, suspend, or remove features at any time. We may also set limits on storage, uploads, downloads, messages, notifications, capsule membership, media quality, or other service features.
We try to keep Capsule reliable, but we do not guarantee that it will always be available, uninterrupted, secure, or error-free.
9. Account suspension and termination
You may stop using Capsule at any time. You may also request account help or deletion through the app or by contacting support.
We may suspend or terminate access to Capsule, remove content, or restrict features if we believe you violated these Terms, created risk for other users, exposed us or others to legal liability, or used Capsule in a way that could harm the service.
Sections that by their nature should survive termination will continue to apply, including ownership, content license as needed for previously shared or retained content, acceptable use, disclaimers, limitation of liability, and dispute provisions.
10. Disclaimers and limitation of liability
Capsule is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the fullest extent permitted by law, Capsule will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, device failure, or unauthorized access, even if we have been advised of the possibility of those damages.
Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the limits above may not apply to you. In those jurisdictions, our liability will be limited to the greatest extent permitted by law.
11. Governing law and disputes
These Terms are intended to be interpreted consistently with applicable law. If a dispute arises, please contact us first so we can try to resolve it informally.
Nothing in these Terms limits any rights you may have under consumer protection laws that cannot be waived by contract.
12. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as updating the date above, posting a notice, or providing an in-app notice.
Your continued use of Capsule after updated Terms become effective means you accept the updated Terms.
